DISPUTE: CLAIM OF EMPLOYES: 1st. That the personal record of Mr. R. D. Maloney, formerly employed as car builder at Marshall shops, Marshall, Texas, be cleared of the discipline notation imposed, resulting in his dismissal from service on February 19, 1936, and his estate be compensated for all time lost from date of his dismissal until date of illness resulting in his demise;
2nd. That his previous status as an employe thereby be restored and his estate be reimbursed for the expense of medical services and hospital facilities, which expenses were incurred by reason of his illness and subsequent death while the request for his reinstatement to service was being handled by the committee with the proper officers of management; and,
3rd. That his group insurance rights and privileges. be restored to the status of the date preceding his dismissal from service and the monetary provisions of his group insurance policy be ordered paid to his (Maloney's) estate.
STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, and the Division is now in receipt of request from the employes that the case be withdrawn.
