DISPUTE: CLAIM OF EMPLOYES: Michael Lemee should have been assigned to work at the New Terminal Enginehouse when there were machinists' jobs open there, after he, as a furloughed machinist from Billerica, had filed application to work elsewhere under Rule 23.


Michael Lemee should be compensated for time lost because machinist helpers were assigned to mechanics' positions at the New Terminal while Lemee's application was on file and mechanics junior to Lemee at his home point were also assigned at the New Terminal during the same period.


STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above parties jointly, and the Division is now in receipt of request from them that the case be withdrawn.




Claim dismissed.
