DISPUTE: CLAIM OF EMPLOYES: 1. That the carrier has persisted in violating the controlling agreement and Rule 6 thereof-

(a) By the assignment of carmen at Rutherford and Newberry Junction, Pennsylvania, since March 8, 1941, on the shop tracks, to work Sundays and holidays for straight time.

(b) By the assignment of carmen at Huntington Street, Philadelphia, Pennsylvania, since June 15, 1941, on the shop tracks, to work Sundays and holidays for straight time.

2. That all service performed by carmen on the Rutherford and Newberry Junction shop tracks on Sundays and holidays, since March 8, 1941, be paid for at the rate of time and one-half.

3. That all service performed by carmen on the Huntington Street, Philadelphia, Pennsylvania, shop tracks on Sundays and holidays since June 15, 1941, be paid for at the rate of time and one-half.

STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, and the Division is now in receipt of request from the employes that the case be withdrawn.
