CHARLESTON & WESTERN CAROLINA RAILWAY COMPANY

DISPUTE: CLAIM OF EMPLOYES: (a) That, under the controlling agreement and specifically Rule 6 thereof, carrier improperly compensated Carman H. H. Gay for service rendered on Sundays and holidays while temporarily relieving regularly assigned Car Inspector J. H. Keels.


(b) That, the carrier be ordered to additionally compensate Carman Gay at the difference between the straight time rate and the time and onehalf rate for all service rendered on Sundays and holidays, or a total of 30 such days while temporarily relieving Car Inspector Keels within the period of October 11, 1942 to April 21, 1943.


STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, and the Division is now in receipt of request from the employes that the case be withdrawn.




Claim dismissed.
