DISPUTE: CLAIM OF EMPLOYES:

1-That there is no authority in the current agreement for depriving Machinist H. F. Stuart of his service rights without a hearing on and since 7:00 A. M., January 17, 1949.


2-That accordingly the carrier be ordered to reinstate this employe in the service with seniority rights unimpaired, and to compensate him for all wages lost retroactive to 7:00 A. M. on the aforesaid date.


STATEMENT:

The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, a hearing thereon was held, and the Division is now in receipt of request from the parties that the case be withdrawn.




    Claim dismissed.
