DISPUTE: CLAIM OF EMPLOYES: 1-That the carrier violated the current agreement when Section Foreman W. H. Phillips, together with four maintenance of way employes, were assigned to rerail L&N cars Nos. 77135 and 61697 on July 9, 1948.
2-That accordingly the carrier be ordered to additionally compensate Carmen John Wilder and Sam Franklin for the aforesaid work and traveling to and from the accident in the amount each of two hours and forty minutes at the time and one-half rate.
STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, a hearing thereon was held, and the Division is now in receipt of request from the employes that the case be withdrawn.
