THE PENNSYLVANIA RAILROAD COMPANY--Central Region

DISPUTE: CLAIM OF EMPLOYES: "It is respectfully submitted that within the meaning of the Controlling Agreement the Pennsylvania Railroad Company has failed to comply with the provisions thereof.


Therefore, we request that the Claimant, S. A. Templeton be compensated the difference between Carman helper and Carman welder rate, as provided in the rate schedule, for 8 hours each day, May 5, fi, and 8, 1950.


This claim is due to the unilateral action of the Carrier in assigning J. E. Orris, a Carman, to a vacancy on the above-mentioned dates in violation of Regulation 2-A-4 and subsequent letters of understanding."


STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, and the Division is now in receipt of a request from the employes that the case be withdrawn.
