DISPUTE: CLAIM OF EMPLOYES: That effective September 15, 1954 the carrier agreed to establish a position as crane car operator in the car shop at Donora, Pa. This was done and three employes bid this job as agreed. The three employes to bid said jobs were Mr. Louis Perry, Mr. Paul Black and Mr. Evo Renacci.


That the Organization does have a contract with the Donora Southern Railroad Company, which is binding on both parties and that Article 26, "Promotions", paragraph (c) of this contract was violated, also paragraph (b).


That the carrier was in error when it did not give Mr. Louis Perry, Mr. Paul Black and Mr. Evo Renacci their seniority in the class in which they bid.


That the carrier be required to establish a class as Crane Car Operator and place Mr. Louis Perry, Mr. Paul Black and Mr. Evo Renacci on this roster.


STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, and the Division is now in receipt of a request from the employes that the case be withdrawn.
