ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY

DISPUTE: CLAIM OF EMPLOYES: 1. That .under the current applicable agreement, the Carrier erred when they assigned Electrical Foreman Mr. Severns to ride train, Del Mar Special, July 27, 1954, from Los Angeles to Del Mar and return, to inspect, note and repair the axle light and air conditioning equipment thereon.


2. That the Carrier be ordered to desist from this practice and assign the proper Electrical Workers Axle Lighting and Air Conditioning Inspectors.


3. That accordingly, for the Agreement violation the Carrier be ordered to pay Electrical Workers Lawrence Wilde and Troy Shupe, either one or the other, depending on which one was available, who have rights to call as Axle Lighting and Air Conditioning Inspectors for the aforesaid time of eight (8) hours July 27, 1954, at the applicable time and one-half rate.


STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, and the Division is now in receipt of a request from the employes that the case be withdrawn.
