DISPUTE: CLAIM OF EMPLOYES: (1) That in accordance with the controlling agreement the Carrier improperly restored the forces in the Machinist Craft at the termination of the Engineers strike at 12:01 A. M., December 6, 1954, by electing to restore junior men to service before senior men were restored to service.


(2) That accordingly the Carrier be ordered to compensate senior Machinists M. Lattuada, C. J. Rossi, J. J. Orlando and D. Gore and senior Machinist Helpers W. A. McCoy, R. L. Knapp, and B. Montbriand in the amount of eight (8) hours at the overtime rate of pay for December 6, 1954.


STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, and the Division is now in receipt of a request from the employes that the case be withdrawn.
