DISPUTE:
CLAIM OF EMPLOYES:
1. That under the current agreement Laborers Charles H.
Boggs and Matthew D. Gerald were improperly denied the right to
exercise their seniority rights when their jobs were abolished June
27, 1954.
2. That accordingly the Carrier be ordered to
a) Permit Laborer Charles W. Boggs to displace
General Laborer C. W. Broughton, Second Shift, work week
assignment Sunday through Thursday with Friday and
Saturday as rest days.
b) Permit Laborer Matthew D. Gerald to displace
General Laborer L. L. Allen, Second Shift, work week
assignment of Wednesday through Sunday with Monday
and Tuesday as rest days.
c) Additionally compensate Laborers Boggs and
Gerald at the time and one-half rate instead of straight time
for each day they were required to work on the job assigned, which were rest days of the jobs desired from June
27, 1954 to date they are permitted to displace the junior
employes.
d) Additionally compensate Laborers Boggs and
Gerald each in the amount of eight hours pay at the
straight time rate for days they were required to remain
home on rest days of the jobs assigned which were regular
work days of the jobs desired from June 27, 1954 to date
they are permitted to displace the junior employes.
EMPLOYES' STATEMENT OF FACTS:
The above question was submitted to the Second Division of the National Railroad Adjustment Board

by the above referred to organization in ex parte form, and the Division is
now in receipt of a request from the employes that the case be withdrawn.

Claim dismissed.
