ERIE RAILROAD COMPANY
DISPUTE:
CLAIM OF EMPLOYES:
1. That the building of metal pontoons out of sheet-iron or
sheet-steel of 16 gauge or heavier is the work of the employes of
the Boilermakers' Craft under the current agreements between Carrier and System Federation No. 100, applicable to the employes at
the Carrier's Marine Yard.
2. That the employes of the Boilermakers' Craft have been unjustly damaged on and subsequent to August 13, 1950 by virtue of
the Carrier having assigned Maintenance of Way Department employes to the work of building these aforementioned metal pontoons.
3. That the Carrier be ordered to compensate, as a penalty for
the aforementioned violations, Boilermakers Loren McDaniels, Joseph
Goodsell, Raymond Valentine, and Boilermaker Helpers Marcus Myers,
Sidney Brook and Charles Fox each at their applicable rates of pay
in the amount of days and hours equal to those for which Maintenance
of Way Department employes received pay for the performance of
the work in question.
STATEMENT OF CLAIM:
The above question was submitted to the
Second Division of the National Railroad Adjustment Board by the above
referred to Organization in ex parte form, and the Division is now in receipt
of a request from the employes that the case be withdrawn.
AWARD
Claim dismissed.
