PARTIES TO DISPUTE:

DEPARTMENT, A. F. of L. (Carmen)
DULUTH, MISSABE AND IRON RANGE RAILWAY COMPANY
DISPUTE: CLAIM OF EMPLOYES:
1. That the Carrier failed to comply with Article V. Section 1(a)
of the August 21, 1954 Agreement and accordingly Carman Helper
Eino Karkinen is entitled to be compensated in the amount of the
claim presented.
2. That under the current agreement Carman Helper Eino
Karkinen was unjustly dealt with when he was denied his service
rights between January 18, 1955 and March 7, 1955.
3. That the Carrier be ordered to compensate Carman Helper
Eino Karkinen for all time lost during the aforesaid period.
STATEMENT OF CLAIM: The above question was submitted to the
Second Division of the National Railroad Adjustment Board by the above
referred to Organization in ex parte form, and the Division is now in receipt
of a request from the employes that the case be withdrawn.
AWARD
Claim dismissed.
