DISPUTE: CLAIM OF EMPLOYES':
1. That the Carrier has failed to comply with the provisions
of the applicable agreement in the handling of a claim of Car Inspector R. Gutierrez, at the time and one-half rate for eight (8)
hours, each, on Christmas Day, December 20, 1955, and New Year's
Day, January 2, 1956, the recognized Holidays.
2. That accordingly, the Carrier be ordered to pay Car Inspector R. Gutierrez at the time and one-half rate for eight (8) hours
for each of the two above named Holidays.
STATEMENT:- The above question was submitted to the Second Division
of the National Railroad Adjustment Board by the above referred to organization in ex parte form, hearing thereon was not held, and the Division is now
in receipt of a request from the employes that the case be withdrawn.
AWARD
Claim dismissed.
