PARTIES TO DISPUTE:
BROTHERHOOD RAILWAY CARMEN OF AMERICA
(Carmen)
BURLINGTON REFRIGERATOR EXPRESS COMPANY
DISPUTE: CLAIM OF EMPLOYES:
1. That under the controlling agreement the Carrier improperly
compensated Junior Mechanic E. B. Lowther for his service while
assigned to perform Carmen's (Painter) duties.
2. That accordingly, the Carrier be ordered to compensate
E. B. Lowther the difference in what he was paid and the Carmen's
rate of pay, from February 4, 1956, until the violation is corrected.
STATEMENT:
The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to
organization in ex parte form, and the Division is now in receipt of a request
from the employes that the case be withdrawn.
AWARD
Claim dismissed.
