PARTIES TO DISPUTE:

INTERNATIONAL ASSOCIATION OF MACHINISTS

DISTRICT LODGE NO. 22


      THE PENNSYLVANIA RAILROAD COMPANY


    DISPUTE: CLAIM OF EMPLOYES:


    1. That under the controlling Agreement the Carrier improperly denied Machinist A. A. Haas the right to be awarded Machinist Relief Advertisement No. 107 dated December 6, 1955, and instead awarded the position to a junior to him.


    2. That accordingly, the Carrier be ordered in accordance with the controlling Agreement to assign Machinist A. A. Haas to the position designated in Advertisement No. 107.


    3. That the Carrier be ordered to compensate Machinist A. A. Haas eight (8) hours' pay at pro rata rate beginning December 19, 1955 for each day he is not permitted to work this position.


STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, hearing thereon was waived, and the Division is now in receipt of a request from the employes that the case be withdrawn.

                  AWARD


    Claim dismissed.
