DEPARTMENT, AFL-CIO (Sheet Metal Workers)
DISPUTE: CLAIM OF EMPLOYES: That the current agreement was violated when other than sheet metal workers were improperly assigned to perform sheet metal workers' work of disconnecting all pipes to a No. 3 refrigerator compressor, and wrapped all the pipe ends closed to avoid dirt getting into the pipes on C&O Diner 1921 on April 23, 1956.
FINDINGS: The Second Division of the Adjustment Board, upon the whole record and all the evidence, finds that:
The carrier or carriers and the employe or employes involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the dispute involved herein.
The facts and circumstances as well as the parties being similar to those herein, disposition of this claim is governed by our Award No. 2747. (Docket No. 2593 CUT-SM.)
Remanded to the parties for further handling in accordance with the provisions of the jurisdictional dispute agreement.
