The Second Division consisted of the regular members and in

addition Referee Livingston Smith when the award was rendered.


PARTIES TO DISPUTE:

SYSTEM FEDERATION NO. 150, RAILWAY EMPLOYES'

DEPARTMENT, AFL (Sheet Metal Workers)


      CINCINNATI UNION TERMINAL COMPANY


    DISPUTE: CLAIM OF EMPLOYES:


    1. That under the current agreement the carrier improperly assigned other than Sheet Metal Workers to perform the work of removing a condenser which made it necessary to unsweat all copper pipes on condenser and disconnect all the water pipes on side of condenser and pipe connections on compressor on PRR coach 4252 on April 16, 1956.


    2. That accordingly the carrier be ordered to compensate Sheet Metal Workers T. Otte and Win. Ryan in the amount of eight (8) hours pay at the applicable rate for April 16, 1956.


FINDINGS: The Second Division of the Adjustment Board, upon the whole record and all the evidence, finds that:


The carrier or carriers and the employe or employes involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act as approved June 21, 1934.


This Division of the Adjustment Board has jurisdiction over the dispute involved herein.


    The parties to said dispute were given due notice of hearing thereon.


The facts and circumstances as well as the parties being similar to those herein, disposition of this claim is governed by our Award No. 2747. (Docket No. 2593 CUT-SM).

                  AWARD


Remanded to the parties for further handling in accordance with the provisions of the jurisdictional dispute agreement.
