The Second Division consisted of the regular members and in

addition Referee Livingston Smith when the award was rendered.


PARTIES TO DISPUTE

SYSTEM FEDERATION NO. 150, RAILWAY EMPLOYES'

DEPARTMENT, AFL-CIO (Sheet Metal Workers)






1. That under the current agreement the Carrier improperly assigned other than Sheet Metal Workers to perform the work of removing and replacing 18 gauge sheet metal around cooler frame, disconnected compressor pipes in their entirety on compressor, connected compressor pipes in their entirety, resweated all necessary pipe joints, repaired leaks marked with white chalk on cooler pipes (this cooler was removed to be repaired for freon leaks and leaks in pipes marked) on NYC Combine June 21, 1956.


2. That accordingly the Carrier be ordered to compensate Sheet Metal Worker G. Katenbrink and Sheet Metal Worker L. Rains each in the amount of eight (8) hours pay at the applicable overtime rate for June 21, 1956.


FINDINGS: The Second Division of the Adjustment Board, upon the whole record and all the evidence, finds that:

The carrier or carriers and the employe or employes involved in this dispute are respectively carrier and enlploye within the meaning of the Railway Labor Act as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.



The facts and circumstances as well as the parties being similar to those herein, disposition of this claim is governed by our Award No. 2747. (Docket No. 2593 CUT-SM).

Remanded to the parties for further handling in accordance with the provisions of the jurisdictional dispute agreement.
