The Second Division consisted of the regular members and in

addition Referee D. Emmett Ferguson when the award was rendered.


PARTIES TO DISPUTE:

SYSTEM FEDERATION NO. 150, RAILWAY EMPLOYES'

DEPARTMENT, AFL-CIO (Sheet Metal Workers)


    THE CINCINNATI UNION TERMINAL COMPANY


    DISPUTE: CLAM OF EMPLOYES:


1. That under the current agreement the carrier improperly assigned other than Sheet Metal Workers to the work of unsweating 11/$ ,, and 1/a " copper pipe to condenser on right side of car, resweated 1-11/$" streamline "ell" fitting left side of car at chamiel leading to right condenser, resweating 11,$ " copper pipe on condenser and renewed about twelve (12) feet of 1/2" copper pipe from left side of car to right side for condenser on B&O Diner 2018, October 15, 1956.


    2. That accordingly the carrier be ordered to compensate Sheet Metal Workers Wm. Ryan and C. Neu, each in the amount of eight (8) hours pay at the applicable overtime rate for October 15, 1956.


FINDINGS: The Second Division of the Adjustment Board, upon the whole record and all the evidence, finds that:

The carrier or carriers and the employe or employes involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.

    The parties to said dispute were given due notice of hearing thereon.


This dispute is identical to that decided in our Award No. 2864 (Docket No. 2778) .
