DISPUTE: CLAIM OF EMPLOYES:
1. That under the controlling agreement:
(a) The Carrier failed to comply with the procedural
requirements.
(b) The Carrier improperly assigned Coach Cleaner
J. H. McPherson to a position of composite Coach Cleaner at
Wildwood, New Jersey on September 16, 1956.
2. That accordingly the Carrier be ordered to:
(a) Allow the claim as presented.
(b) Remove the aforesaid employe from the position of
composite Coach Cleaner.
(c) Recall the senior furloughed Coach Cleaner to
service and to compensate him at the applicable straight
time rate of pay for all time lost due to the aforesaid
violation.
STATEMENT: The above question was submitted to the Second Division
of the National Railroad Adjustment Board by the above referred to organization in ex parte form, and the Division is now in receipt of a request from the
employes that the case be withdrawn.
