DISPUTE:
CLAIM OF EMPLOYES:
1. That the Texas-Mexican Railroad Company violated the controlling agreement, particularly Rule 20(a) and (b), by depriving Mr.
Manuel G. Herrera, Carman, of working his bid in job following the
expiration of the bulletin and assignment.
2. That accordingly, the Texas-Mexican Railroad Company be
ordered to compensate Carman Herrera as follows:
a) 1 hour at the straight time rate for May 3, 6 and
7, 1957 for being deprived of working his regular assignment;
b) 7 hours at the time and one-half rate for May 3, 6
and 7, 1957 for being required to work hours in excess of his
regular assignment;
c) The difference between the straight time rate and
the time and one-half rate for May 4 and 5, 1957 for being
required to work the rest days of his regular assignment, and,
d) 8 hours at the straight time rate for May 8 and 9,
1957 account of not being allowed to work the days of his
regular assignment.
STATEMENT: The above question was submitted to the Second Division
of the National Railroad Adjustment Board by the above referred to organization in ex parte form, and the Division is now in receipt of a request from the
employes that the case be withdrawn.
