DISPUTE: CLAIM OF EMPLOYES: R. W. Rankin was a furloughed employe. A younger employe, L. Younkins was recalled before R. W. Rankin and worked on December 7th and 8th, 1957. This is a violation of our agreement Rule 40, paragraph (d) as he was not notified as per this paragraph. Since a younger employe worked Dec. 7th and 8th, 1957 the Organization requests that R. W. Rankin be compensated eight (8) hours for each day that the younger man worked.


STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form and the Division is now in receipt of a request from the employes that the case be withdrawn.
