addition Referee D. Emmett Ferguson when the award was rendered.
PARTIES TO DISPUTE
SYSTEM FEDERATION NO. 12, RAILWAY EMPLOYES'
DEPARTMENT, AFL-CIO (Machinists)
CHICAGO AND NORTHWESTERN RAILWAY COMPANY
DISPUTE: CLAIM OF EMPLOYES:
1. That the Carrier violated Rules 6 and 16 of the current
Agreement and letters of understanding dated September 6 and 8,
1944, by permitting Assistant Foreman F. Reno to exercise his
Machinists' seniority when he voluntarily relinquished his position as
Assistant Foreman at Green Bay, Wisconsin, thereby damaging the
following Machinists: C. Ducas, A. Reynolds, A. J. Dart, J. W.
Roble, W. Swanson, E. Bodette, J. Krouth and G. Steene.
2. That accordingly the Board order these Machinists paid for
all time they were forced to work on days and shifts from September
4 to December 18, 1956, other than their regular assignments prior to
Assistant Foreman F. Reno exercising his Machinists' seniority in
violation of the rules and letters of understanding.
STATEMENT:
The above question was submitted to the Second Division
of the National Railroad Adjustment Board by the above referred to organization in ex parte form, and the Division is now in receipt of a request from
the employes that the case be withdrawn.
AWARD
Claim dismissed.
