DISPUTE:
CLAIM OF EMPLOYES:
1. That under the controlling agreement, the Carrier is without
authority to require employes to undergo regular annual physical
examinations.
2. That, accordingly, the Carrier be ordered to compensate
Car Inspector Eustace Eggie for one (1) hour's pay at the time
and one-half rate account of being required-on his own time-to
submit to an annual physical examination on April 8, 1958.
STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to
organization in ex parte form and the Division is now in receipt of a request
from the organization that the case be withdrawn.
AWARD
Claim dismissed.
