      CHESAPEAKE & OHIO RAILWAY COMPANY


    DISPUTE: CLAIM OF EMPLOYES:


    1. That on June 12, 1958, the Carrier violated the controlling agreement, particularly Rule 158 thereof, when shop laborers were used to rerail Diesel Engine No. 5093 at its Russell, Kentucky Roundhouse.


    2. That accordingly, the Carrier be ordered to compensate Carmen Paul Reese, Alva Mowery, W. K. Miller and ice. W. Vallance for four hours at the straight time rate of pay.


STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organiza. tion in ex parte form and the Division is now in receipt of a request from the employes that the case be withdrawn.

                  AWARD


    Claim dismissed.
