DISPUTE: CLAIM OF EMPLOYES:
1. That under the rules of the current agreement, Blacksmith
Helper Olen Embry, was unjustly denied his right to fill vacation
vacancy of Blacksmith Helper Chester Heman from September 29,
1958 to October 17, 1958, both dates inclusive.
2. That accordingly the Carrier be ordered to compensate
Blacksmith Helper Olen Embry for 15 days, 8 hours each, at his
applicable Helpers' rate of pay on account of this violation.
STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to
organization in ex parte form and the Division is now in receipt of a request
from the employes that the case be withdrawn.
AWARD
Claim dismissed.
