The Second Division consisted of the regular members and in
addition Referee Francis B. Murphy when award was rendered.
PARTIES TO DISPUTE:
SYSTEM FEDERATION NO. 2, RAILWAY EMPLOYES'
DEPARTMENT, AFL-CIO (Sheet Metal Workers)
MISSOURI PACIFIC RAILROAD COMPANY
DISPUTE: CLAIM OF EMPLOYES:
1. That the Claim of Employes is subject to be allowed as
presented account Carrier's violation of Article V of the August 21,
1954 Agreement when it did not reply to the employes' appeal of
January 8, 1958 until March 17, 1958.
2. That under the current agreement Sheet Metal Workers
A. Q. Link, Clifton Main and E. H. Bassett were improperly furloughed and other than Sheet Metal Workers were assigned to
perform Sheet Metal Workers' work.
3. That accordingly the Carrier be ordered to compensate the
aforesaid employes for all time lost since April 24, 1957.
STATEMENT:
The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to
organization in ex parte form, hearing thereon was held, and the Division is
now in receipt of a request from the employes that the case be withdrawn.
