THE TEXAS & PACIFIC RAILWAY COMPANY
DISPUTE: CLAIM OF EMPLOYES:
1. That at Mineola, Texas on January 2E, 1959, the Carrier
violated the current agreement particLlarly rules 21 and 89 by
assigning other than Carmen to make road trip to Hoard, Texas to
make temporary repairs to Stock Car IC 45307 loaded with cattle.
2. That accordingly the Carrier be ordered to compensate
Carmen M. R. Stephenson and C. T. Chrietzberg in the amount '/$
hour for traveling at straight time rate and 3% hours at the time
and one-half rate for working under Rule 5 of the current Agreement.
STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to
organization in ex parte form, and the Division is now in receipt of a request
from the employes that the case be withdrawn.
AWARD
Claim dismissed.
