DISPUTE: CLAIM OF EMPLOYES:
R. Thomas holds a regular car repairman job at the Gateway
Car Shop. On February 19, 1959 he was sent by the carrier to Briar
Hill to work on air on a train of cars in the inspection yard. This
work belongs to car inspectors who receive jobs in the inspection
yards by bid. Since a car repairman was used to perform work that
belongs to car inspectors the organization asks the carrier to compensate extra car inspector P. Wesolowsky who was available and
entitled to this work, four (4) hours for February 19, 1959.
On February 24, 1959 the same thing happened and car repairman J. Hvizdak and A. Dutko were sent to Briar Hill to perform the
work of car inspectors. Since there were no extra car inspectors
available on this date the organization requests that the carrier compensate car inspector Notary who was entitled to this work under the
overtime agreement, four (4) hours at the punitive rate of pay.
On February 25, 1959 again the same thing happened. Carmen
R. Thomas and T. Rasile were used instead of car inspectors. No extra
car inspectors available, car inspector J. Adams was entitled to this
work and the organization requests the carrier to compensate J.
Adams four (4) hours at the punitive rate of pay.
March 2, 19'59 car repairmen Hvizdak and Dutko were again
used to do car inspectors work at Briar Hill. Extra car inspector J.
Briganto was available for this work and the organization requests
that the carrier compensate him four (4) hours at the pro-rata rate
of pay for this day.
STATEMENT: The above question was submitted to the Second Division
of the National Railroad Adjustment Board by the above referred to organization in ex parte form, hearing thereon was held, and the Division is now in
receipt of a request from the parties that the case be withdrawn.
