DISPUTE: CLAIM OF EMPLOYES: On May 2, 1960 J. J. Germak, car inspector, bid a job as Glassport-Wylie relief. On the bid it stated that bidder to get position must have operator's license. The bidder J. J. Germak stated he could use public transportation or travel with yard crew and still work this position but he was turned down because he had no driver's card. Car inspector Germak is the senior car inspector and should have received position instead of junior employe Gallagher. When car inspector Germak was hired he was not told that he must have an operator's card nor is there anything in the agreement that states that any employe must have an operator's card. The organization would like to have this practice stopped at once and award jobs advertised as per agreement.


STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form. Parties to said dispute were given due notice of hearing thereon, and the Division is now in receipt of a request from the employes that the case be withdrawn.
