CHICAGO & NORTH WESTERN RAILWAY COMPANY
DISPUTE: CLAIM OF EMPLOYES:
1. The Chicago, St. Paul, Minneapolis & Omaha Railway Company, hereinafter referred to as the Carrier, on November 30, 1955,
Decmber 5, 6, 7, 8, 14, 16, 19 and 21, 1955 elected to assign Carmen to
remove three gasoline engines on motorcars at the Sioux City Motor
Car Shops, work which is classed as Machinist work in the current
Shop Crafts Agreement, Rule 58, while Machinist Elmer Peterson,
hereinafter referred to as claimant, holding seniority in said department, was available for call.
2. The Carrier be ordered to pay time claims filed in due form
on behalf of Machinist Elmer Peterson.

3. Further, the Carrier be instructed to refrain from assigning
employes other than Machinists to perform Machinist work at Sioux
City Motor Car Shops in the future.
STATEMENT: The above question was submitted to the Second Division
of the National Railroad Adjustment Board by the above referred to organization in ex parte form, hearing thereon was held, and the Division is now in
receipt of a request from the employes that the case be withdrawn.

Claim dismissed.
