1. That the controlling agreement, particularly Rule 25 (a), was violated on Saturday, July 2, 1960, when the Missouri Pacific Railroad Co. sent carman from Wichita, Kansas to El Dorado, Kansas, a one-man point, to make repairs to Car GATX 36896, even though Carman L. R. Cottrell, the only carman holding seniority at El Dorado was available for call to make these repairs to car GATX 36896 on Saturday, July 2, 1960.


2. That accordingly the Missouri Pacific Railroad Company be ordered to compensate Carman L. R. Cottrell in the amount of two hours, forty minutes (2'40") at the overtime rate for Saturday, July 2, 1960.


,STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, hearing thereon was waived, and the Division is now in receipt of a request from the employes that the case be withdrawn.




    Claim dismissed.
