THE PITTSBURGH & LAKE ERIE RAILROAD COMPANY AND
THE LAKE ERIE & EASTERN RAILROAD COMPANY
DISPUTE: CLAIM OF EMPLOYES: On March 13, 1962, three cars, numbers P-9555, P-10655, P12732 were derailed in the McKees Rocks Yard. On March 14, 1962, eight (8) MofW employes were used to rerail these cars. This is a violation of the agreement, Rule 27, paragraph (a) as we do have a wreck crew at McKees Rocks, Pa. and they should have performed the work instead of the MofW employes. Since the MofW employes were used the organization requests that the following wreck crew members be paid eight (8) hours at the regular carmen's rate of pay on account of MofW employes performing their work. Employes to be paid: A. Stecko, M. Novoselski, M. Rosko, R. Schutz, F. Wolota, E. Hannisick, E. Maksin and F. Kownacki.
STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, hearing thereon was held, and the Division is now in receipt of a request from the employes that the case be withdrawn.
