The Second Division consisted of the regular members and in

addition Referee Paul C. Dugan when award was rendered.


PARTIES TO DISPUTE:
SYSTEM FEDERATION NO. 44, RAILWAY EMPLOYES'
DEPARTMENT, AFL-CIO (Electrical Workers)
CLINCHFIELD RAILROAD COMPANY

    DISPUTE: CLAIM OF EMPLOYES:


    1. That the carrier violated the current agreement when it refused to pay Electricians H. C. Linville and H. H. Bradshaw holiday pay for Christmas Day holiday 1960.


    2. That accordingly Electricians H. C. Linville and H. H. Bradshaw each be compensated eight hours' pay at the pro rata hourly rate of their position.


FINDINGS: The Second Division of the Adjustment Board, upon the whole record and all the evidence, finds that:

The carrier or carriers and the employe or employes involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.

    Parties to said dispute were given due notice of hearing thereon.


Claimants (2 Electricians) are making claim for holiday pay for Christmas Day, December 25, 1960, after being furloughed effective December 27, 1960. The sole issue in this dispute was decided by this Division in Award 5061, and for the reasons set out in said award, we will sustain this claim.

                  AWARD
