The Second Division consisted of the regular members and in
addition Referee Paul
C. Dugan when award was rendered.
PARTIES TO DISPUTE:
SYSTEM FEDERATION NO. 3, RAILWAY EMPLOYES'
DEPARTMENT, AFL-CIO (Machinists)
THE KANSAS CITY SOUTHERN RAILWAY COMPANY
DISPUTE: CLAIM OF EMPLOYES:
1 - That under the current agreement the Carrier has unjustly
dealt with Machinists B. D. Grubbs and E. C. Matthews when they
denied them Holiday pay for Thanksgiving Day, November 24, 1960.
2 - That accordingly the Carrier be ordered to additionally
compensate the aforementioned Machinists each in the amount of
eight (8) hours pay at the prevailing rate.
FINDINGS: The Second Division of the Adjustment Board, upon the
whole record and all the evidence, finds that:
The carrier or carriers and the employe or employes involved in this.
dispute are respectively carrier and employe within the meaning of the
Railway Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the dispute
involved herein.
Parties to said dispute waived right of appearance at hearing thereon.
The issue herein in regard to holiday pay for 2 Machinist Claimants for
Thanksgiving Day, November 24, 1960, is similar to the issue decided in
Award 5061, and for the reasons stated in that award, we will sustain this
claim.
