NATIONAL RAILROAD ADJUSTMENT BOARD
SECOND DIVISION
The Second Division consisted of the regular members and in
addition Referee Paul C. Dugan when award was rendered.
PARTIES TO DISPUTE:
SYSTEM FEDERATION NO. 99, RAILWAY EMPLOYES'
DEPARTMENT, AFL-CIO (Sheet Metal Workers)
ILLINOIS CENTRAL RAILROAD COMPANY
DISPUTE: CLAIM OF EMPLOYES:
1. That, contrary to the provisions of the Agreement of August 19, 1960, Article III-Holidays, the Illinois Central Railroad
Management refused to compensate Sheet Metal Worker C. R. Stone,
and Sheet Metal Worker Apprentice, E. C. Green, Jr., Paducah
Shop, Paducah, Kentucky in the amount of eight (8) hours each
at the regular rate of pay for January 2, 1961 (Holiday).
2. That, the Carrier be ordered to compensate Sheet Metal
Worker C. R. Stone and Sheet Metal Worker Apprentice, E. C.
Green Jr., in the amount of eight (8) hours pay each at the
regular rate of pay for January 2, 1961.
FINDINGS: The Second Division of the Adjustment Board, upon the
whole record and all the evidence, finds that:
The carrier or carriers and the employe or employes involved in this
dispute are respectively carrier and employe within the meaning of the
Railway Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the dispute
involved herein.
Parties to said dispute waived right of appearance at hearing thereon.
The issue and agreement in this holiday pay dispute are similar to the
issue and agreement in Award 5105, and for the reasons stated in that
Award this claim will be sustained.
