BALTIMORE AND OHIO RAILROAD COMPANY
DISPUTE: CLAIM OF EMPLOYES:
That under the controlling agreement, the Baltimore and Ohio
Railroad Company damaged Machinist P. Bogle,
by
suppressing his
seniority rights to a position worked
by
a junior employe from the
date of June 21, 1966.
That accordingly, the Carrier be ordered to compensate the
Claimant until he is reinstated with respect to wage loss, vacation
rights, as well as his rights for hospital, surgical and medical benefits and group life insurance.
FINDINGS: The Second Division of the Adjustment Board, upon the
whole record and all the evidence, finds that:
The carrier or carriers and the employe or employes involved in this dispute are respectively carrier and employe within the meaning of the Railway
Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the dispute
involved herein.
Parties to said dispute were given due notice of hearing thereon.
This case which is a companion case to Docket No. 5501 is controlled by
the findings in Award No. 5389, and therefore becomes moot.
AWARD
Disposed of in Award No. 5389.
