DISPUTE: CLAIM OF EMPLOYES:

1 - That the Terminal Railroad Association of St. Louis violated the Agreement of February 4, 1965, when they denied birthday holiday pay to M. A. Gray, Machinist, Thursday, August 5, 1965.. Brooklyn, Illinois.


2 - That accordingly, the Terminal Railroad Association of StLouis be ordered to compensate Machinist Gray in the amount of eight (8) hours for August 5, 1965, his birthday holiday.


FINDINGS: The Second Division of the Adjustment Board, upon the vhole record and all the evidence, finds that:

The carrier or carriers and the employe or employes involved in this disiute are respectively carrier and employ e within the meaning of the Railway .abor Act as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute zvolved herein.

Parties to said dispute waived right of appearance at hearing thereon.

The parties hereto ,have stipulated and agreed that this claim shall be isposed of by the findings as contained in Award No. 5414 for the reason that its dispute involves the same issue. Accordingly, this claim shall be denied.
