The Second Division consisted of the regular members and in

addition Referee George S. Ives when award was rendered.


PARTIES TO DISPUTE:

SYSTEM FEDERATION NO. 42, RAILWAY EMPLOYES'
DEPARTMENT, AFL-CIO (Machinists)

    SEABOARD COAST LINE RAILROAD COMPANY


    DISPUTE: CLAIM OF EMPLOYES:


    1. That under the current agreement, Machinist Frank Smith was unjustly treated when he was not allowed to return to service on December 13, 1965.


      2. That accordingly the Carrier be ordered to:


          (A) Compensate him for all time lost from December 13, 1965 until he is restored to service.


          (B) Restore to him all vacation rights, insurance rights and all other rights for all time held from service.


STATEMENT: The above question was submitted to the Second Division of the National Railroad Adjustment Board by the above referred to organization in ex parte form, hearing thereon was waived, and the Division is now in receipt of a request from the Employes that the case be withdrawn.

                  AWARD


    Claim dismissed.
