THE BALTIMORE AND OHIO RAILROAD COMPANY
DISPUTE: CLAIM OF EMPLOYES:
1. That under the current Agreement the Carrier on April 21,
1966, improperly furloughed and suspended from the service
four (4) Machinists, employed at the Grafton Shops, Grafton,
West Virginia.
2. That the Carrier be ordered to compensate the following Machinists, J. R. McWilliams and H. E. Board, from the date of
April 22, 1966, until May 2, 1966; G. J. Lambert, from April
25, 1966, until May 2, 1966; H. K. Pratt, from April 21, 1966,
until May 5, 1966.
FINDINGS: The Second Division of the Adjustment Board, upon
the whole record and all the evidence, finds that:
The carrier or carriers and the employe or employes involved in this
dispute are respectively carrier and employe within the meaning of the
Railway Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the dispute involved herein.
Parties to said dispute waived right of appearance at hearing thereon.
The facts involved in this dispute are identical to those facts contained in Award No. 5720. Therefore, this claim will be denied for the same
reasons as contained in Award No. 5720.
