GULF, MOBILE AND OHIO RAILROAD COMPANY
DISPUTE: CLAIM OF EMPLOYES:
1. That the Gulf, Mobile and Ohio Railroad Company violated the
Agreement of February 4, 1965, when they denied Birthday-Holiday
pay to Machinists I. B. Thomas on Friday, June 4, 1965; A. J.
Ray on Wednesday, June 30, 1965; R. E. Simpson on Frdiay,
September 10, 1965; R. B. Whatley on Thursday, December 9, 196'5;
R. A. Dietrich on Wednesday, March 23, 1966; B. A. Veteto on
Tuesday, May 3, 1966; and to B. A. Veteto on Wednesday, May 3,
1967.
2. That accordingly the Gulf, Mobile and Ohio Railroad Oompany be
ordered to compensate Machinists Thomas, Ray, Simpson, Whatley,
Dietrich, Veteto and Veteto in the amount of eight (8) hours
pro par on the days set out above.
FINDINGS:
The Second Division of the Adjustment Board, upon the whole record and
all the evidence, finds that:
The carrier or carriers and the employe or employes involved in this
dispute are respectively carrier and employe within the meaning of the Railway Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the dispute
involved herein.
Parties to said dispute waived right of appearance at hearing thereon.
The facts and the issue presented in this case are identical to these in
Award Number 5818. For the reasons stated in that award, we will sustain
the claim.
