NORFOLK AND WESTERN RAILWAY COMPANY
DISPUTE:
CLAIM OF EMPLOYES:
1. That the Norfolk R Western Railway Company is in violation
of Rule No. 17 of the Agreement of September 1, 1949, between the
Norfolk and Western Railway Company, and the employes represented
by System Federation No. 16, through failure to bulletin. jobs and
vacancies, in the Carmen's Craft, at the East End Shops, Roanoke,
Virginia. Particularly so with respect to the vacancy created by the
death of Car Repairer A. J. Bohon.
2. That the Norfolk and Western Railway Company be ordered
to comply with Rule No. 17, of Current Agreement and bulletin the
job formerly held by said A. J. Bohon, in such manner, as to describe
the duties thercaf in identifiable manner, so as to enable the employes to exercise their seniority in an intelligent manner in bidding
on same.
FINDINGS: The Second Division of the Adjustment Board, upon the
whole record and all the evidence, finds that:
The carrier or carriers and the employe or employes involved in this dispute are respectively carrier and employe within the meaning of the Railway
Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the dispute
involved herein.
Parties to said dispute waived right of appearance at hearing thereon.
In that identical principlcs and parties are involved in both cases, the
disposition of the instant case is governed by Award 6091, National Railroad
Adjustment Board, Second Division.
