PARTIES TO DISPUTE
SYSTEM FEDERATION NO. 16, RAILWAY EMPLOYES'
DEPARTMENT, A. F. of L. - C. 1. O. (Carmen)
NORFOLF AND WESTERN RAILWAY COMPANY
DISPUTE: CLAIM OF EMPLOYES:
1. That the Norfolk and Western Railway Company is in violation
of Rule No- 17 of the Agreement of September 1, 1949, between the
Norfolk and Western Railway Company and the employes represented
by System Federation No. 16, failure to identify and specify, the duties
and location, for the purpose of exercising seniority, the positions of
three (3) Car Repairers advertised by bulletin dated May 19, 1969 at
Norfolk, Virginia.
2. That the Norfolk and Western Railway Company be ordered to
bulletin jobs and vacancies, in an identifiable manner, as to enable the
employes to determine or not the positions would be desirable to them.
FINDINGS: The Second Division of the Adjustment Board, upon the
whole record and all the evidence, finds that:
The carrier or carriers and the employe or employer involved in this
dispute are respectively carrier and employe within the meaning of the Railway Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the dispute
involved herein.
Parties to said dispute waived right of appearance at hearing thereon.
The parties and the issues presented in this dispute are identical to those
in our Award No. 6272. For the reason stated in that Award and previous
Awards of this Division we will deny the claim.
AWARD
Claim denied.
