That he was employed at Woodcrest Shop of I.C.R.R. - 17550 South
Ashland Ave.., Homewood,, Illinois, as a Laborer, Clock No. 17104 from
about 10/29/66 to 11/14/70. That on or about December 2, 1970 this
Employee was
dismissed
from his job by tdr. Jeffrey, as a result of an
Investigation Report taken on Nov. 20, 1970.
Findings:
The Second Division of the
Adjustment Board, upon the whole
record and
'11 the evidence, finds that:
The carrier or
carriers
and
the employe or employes involved in this
dispute are respectively carrier and employe within the t:eaning of the Railway I
Labor Act as approved June 21, 1934.
This Division of the Adjustment Board has jurisdiction over the dispute
involved
herein.
Parties to said dispute were given due notice of hearing thereon.

Without considering the substantive merits of the claim, it is j
clear from an examination of the record before us that the claimant ignored the
appeals procedure on the property in violation of Section 3, First (i) of the
Railway Labor Act. We have no alternative other than to dismiss the claim.
