Dispute: Claim of Employes:
1. That Carman C. L. Payne was unjustly dealt with when he
Sas removed from service of the Port Terminal Railroad
Association, Houston, Texas, effective March
16, 1973.
2. That accordingly, Carrier be ordered to restore Claimant
Payne to service wtih all seniority and other rights
unimpaired and compensate him for all time lost retroactive to March 16,
1973;
make him whole for all vacation
rights; and make him whole for all hospital, surgical,
medical and group life insurance for the period held out
of service.

The above question was submitted to the Second Division of the
National Railroad Adjustment Board by the above referred to organization
in ex parte form, hearing thereon was waived, and the Division is now
in receipt of a request from the employes that the case be withdrawn.
