1. That the controlling agreement, particularly Rule 23 (b) was violated when the Missouri Pacific Railroad Company permitted Carman Tobe Smith to retain his seniority date at Monroe, Louisiana after he transferred to McGehee, Arkansas.

2. That accordingly, the Missouri Pacific Railroad Company be ordered to correct the seniority roster and show Carman Smith's seniority date as September 11, 1972, the date he transferred and commenced work at McGehee, Arkansas.

Statement:

The above question~was submitted to the Second Division of the National Railroad Adjustment Board by the above referred.to organization in ex paste form, hearing thereon was waived, and.the Division is now in receipt of a request from the employes that the case be withdrawn.
