Dispute: Claim of Employes:
(1) That under the ccntrolling Agreement other than qualified Car
Repairman and Welders were and are being used to perform Car
Repairman and Welder's work, in violation of Rule 7.4, Section
4 (a).
(2) That, concurrently, under the controlling Agreement, the Carrier
violated Rule 6, Seniority Section 4 (a), when it abolished five
(5) day turn Car Repairman's position and refused to advertise
them meanwhile filling these positions, on a daily basis, by
using helpers to perform the work.
(3) That, accordingly, the Carrier be ordered to compensate
~'~ , employees named in Exhibits A and B, at their pro-rata, eight
hours pay for each day enumerated in Exhibits A and C, as
penalty for these concurrent violations, and that the Carrier
be ordered to comply with the plain and unambigious provisions
of the Agreement.
Statement:
The above questions was submitted to the Second Division of the
National Railroad Adjustment Board by the above referred to organization in
ex parte form, hearing thereon was waived, and the Division is now in receipt
of a joint request from the parties that the case be withdrawn.
