Dispute: Claim of Employes:

1. That the Long Island Rail Road Company acted improperly when they refused to accept E. Duffy's displacement application for a position held by Junior-Electrician K. Forte on May 8, 1973.

2. That, accordingly, the Long Island Rail Road Company be

ordered to accept E. Duffy's displacement of junior

Electrician K. Forte effective May 8, 1973 and to compen

sate E. Duffy $736.99 due from May 9, 1973 to and including

June 19, 1973, and additionally compensate E. Duffy all

pay and penalties due him from June 20, 1973 to date of

settlement of this claim, including all overtime hours

deprived of and all subsequent pay raises and night

differentials due on this continuous claim.

Findings:

The Second Division of the Adjustment Board, upon the whole record and all the evidence, finds that:

The carrier or carriers and the employe or employes involved in this dispute are respectively carrier and employe within the meaning of the Railway Labor Act as approved June 21, 1934.

This Division of the Adjustment Board has jurisdiction over the dispute involved herein.

Parties to said dispute were given due notice of hearing thereon.

The issue in this dispute involved the alleged impropriety of Carrier's refusal to honor. a displacement bid by Claimant over a junior Electrician. The record indicates that this dispute is identical, but for a different Claimant, to that considered by this Board recently in Award 6939. For the reasons indicated in that Award the instant Claim must similarly be sustained.
