Dispute: Claim of Employes:
1. That under the current controlling agreement Machinist Helper
Willie F. Oates, Argentine, Kansas, was unjustly dismissed from
the service of the AT&SF Railway Co. on September 7, 1973.
2. That accordingly the Carrier be ordered to reinstate Claimant to
his former position with all service rights, seniority and pay
for all time lost from Carrier service retroactive to September 7,
1973.
Statement:
The above question was submitted to the Second Division of the National
Railroad Adjustment Board by the above referred to organization in
ex parte
form, hearing thereon was waived, and the Division is now in receipt of a
request from the employes that the case be withdrawn.
